Ownership & buying

How ownership works — honestly.

Villas are leasehold. Foreigners cannot own land in Thailand, so these villas are held on a registered long-term lease (30 years, renewable) with a land-lease extension, and the building titled to you. We'll walk you through it.

Use your own independent Thai lawyer (not the developer's) to review the lease and extension terms.

    200,000 THB non-refundable reservation deposit secures your plot and layout.

    Contract

    20% payable on signing the contract, once your independent Thai lawyer is satisfied.

    Construction

    Nine monthly stage payments through the build. Timing is flexible — you can agree contracts now and delay construction if you prefer.

    Living there

    Estate common fee currently 3,000 THB/month: 24-hour security, management and maintenance staff, fitness facilities and daily refuse collection.

About the development

Baan Phu Thara is an award-winning community of private pool villas in Hua Hin, Prachuap Khiri Khan, Thailand. It is a community solar development — every property is built with underground electrics and solar power as standard. The development holds full Chanote land title throughout and won two awards at the 2017 Thailand Property Awards. Baan Phu Thara Mountainside is the newer sister development, offering villas on elevated plots with mountain views, built to the same specification and standards.

Thai Country Homes was founded by Mr. Eakkarat Suppagarn, a civil engineer with over 25 years' experience and 9 completed developments, and is led by Mr. Scott Beecham, Director of TCH Hua Hin Co., Ltd. The development has its roots in the award-winning Smart House Valley project, which established the quality standards Baan Phu Thara continues today.

Buying a property — first steps

Yes. The show-house represents the quality and finish of the properties. Please note not all items on display are supplied as standard to all villa types — before signing any contract, confirm in writing exactly what is included in your specific purchase. We can arrange a visit for you.

We strongly recommend it. Although contracts may be signed directly with the developer, independent legal advice from a lawyer experienced in Thai property law is always advisable before signing any document, and you are entirely free to use any lawyer of your choosing. The developer covers the cost of its legal partner to prepare the standard Sales & Construction Contract, Land Lease and Maintenance Agreement — a saving of up to 70,000 Baht. We receive no payment for referring buyers to any lawyer.

Purchase costs

At current rates set by the Hua Hin Land Office, registering a 30-year land lease costs approximately 1.1% of the land lease price. Land Office fees are set by the Thai government and may change — always confirm the current rate with your lawyer before purchase.

In addition to the villa sales price and lease registration fee, budget for: a sinking fund of 30,000 Baht per property (payable on completion and transfer); legal fees if you use a lawyer beyond the standard developer contracts; international bank transfer charges (all sending and receiving bank charges are for the buyer's account); and a Thai Last Will and Testament, which we recommend all foreign buyers make. For company purchase structures, transfer fees and taxes are approximately 6.3% of the property value plus annual accounting fees. Full details are available from us on request.

Yes, with the right legal structure. In summary: leasehold is the most widely used and legally secure route for foreign buyers — a 30-year lease registered at the Land Office against the Chanote title deed; freehold is available to Thai nationals only; a company purchase is possible but carries higher costs and significantly increased regulatory scrutiny since January 2026. Independent legal advice is essential, and full details are available from us on request.

Design, specifications & modifications

All villas are supplied with the following as standard unless otherwise specified in writing: underground electrics; community solar power system; air conditioning and ceiling fans throughout; a fully fitted European-standard or bespoke Thai-manufactured kitchen including oven, hob, extractor and microwave; built-in wardrobes and closets in all bedrooms; plastered internal walls; mosquito and fly screening to all external sliding doors and bathroom windows; a water filtration system (not for drinking water); landscaped gardens; a private swimming pool; and an external storage room. The full included specifications by villa type are available from us on request.

Yes. We aim to be as flexible as possible within the practical constraints of a development build. If the property size stays the same, the original sales price can generally be held; if it increases, it is priced accordingly. Any agreed modifications must be confirmed in writing before construction begins, and extensive personal changes may extend the timeline. Internal dimensions are calculated from the centre of the supporting columns.

Yes. Built-in quality wardrobes are included in all bedrooms as standard.

Yes. All villa designs are wheelchair-access friendly, with wider door openings and ramped pathways throughout.

An optional furniture package is available with every villa. You receive a furniture coupon of a set value (depending on villa type) redeemable at the developer's furniture supplier, and choose exactly what you want within the budget. The coupon face value is the retail price; a 50% trade discount has been negotiated, so the actual cost included in your sales price is 50% of the face value. If you don't want the package, 50% of the face value (the actual cost) is deducted from your sales price.

Utilities & infrastructure

Yes. The development is connected to the Provincial Electricity Authority (PEA) grid, with all electricity running underground — no overhead poles or wires. Each property has a solar power system as standard; power generated above your consumption is fed back into the grid unless you add battery storage. Because of the underground system, PEA does not install individual meters per property, so the development uses digital sub-meters and adds 1 Baht per unit to the PEA charge to cover metering upkeep. A move to direct per-property billing has been requested and remains under review; buyers will be updated on any change.

Yes. The development is connected to the Pranburi Water Supply, and each property is billed directly by the water authority. The developer cannot be held responsible for interruptions to supply provided by external authorities.

Yes. Fibre-optic internet is available; landline telephone is available too, though most residents use mobiles. The development management team will help arrange your connection after handover.

Sewage is managed by individual septic tanks for each property.

Construction & payment

The standard build time is 9 to 12 months from the agreed construction start date. Extensive customisations may extend this. A 2-week quality check and snag period is reserved at the end before handover.

(1) Reservation deposit — 200,000 Baht (non-refundable), reserving your chosen plot; for two adjoining plots only one deposit is required. The plot is held for 60 days while contracts are prepared; if not signed within 60 days, a further 200,000 Baht extends the reservation for each additional 30-day period. (2) First payment — 20% of the full sales price, due within 7 days of signing contracts; a discount is available if a larger amount is paid at this stage — please ask us for details. (3) Monthly instalments — the remaining balance, less the 200,000 Baht deposit, paid in equal monthly payments through the construction period. (4) Final payment — due on completion and handover; occupation is not permitted until the final payment is made. Once the 20% is paid, construction can be deferred by mutual agreement for up to one year.

Yes. Once the initial 20% payment is made, the start of construction can be deferred for up to one year by agreement.

Most overseas buyers transfer funds directly from their home bank. All sending and receiving bank charges are for the buyer's account, so ensure transfers account for fees. Payments in Thailand may be made by cash or bank cheque. Land payments are made to Thai Country Home Hua Hin Co., Ltd; construction payments to Hua Hin Quality House Co., Ltd.

Yes. Monthly photographic updates are sent by email showing construction progress, or more frequently on request.

Legal & ownership

Yes. All land within Baan Phu Thara and Baan Phu Thara Mountainside carries full Chanote title (Nor Sor 4 Jor) — the highest and most legally secure form of land title in Thailand.

Yes. Under Thai law a foreign national can legally own the physical structure (the building) in their own name, with the land secured separately through a registered 30-year leasehold. This is the standard, legally recognised structure for foreign villa buyers in Thailand.

If you sell before the lease expires, the buyer can have the remaining term re-assigned into their name at a cost of approximately 50,000 Baht, or request a new 30-year lease at the then-prevailing Land Office rate (currently approximately 1.1% of the land lease price). We always recommend taking legal advice before deciding.

If your property is left to your heirs by a valid Thai Will, the lease can be re-assigned into their names (a transfer fee applies). We strongly recommend all foreign buyers make a Thai Last Will and Testament.

Before construction begins, all parties sign the Sales & Construction Contract, the Land Lease Agreement (or alternative ownership document), the Maintenance Agreement, and the Rules & Regulations Agreement. Copies of all draft documents are available on request before signing.

Estate costs & facilities

A compulsory common fee of 3,000 Baht per plot per month is payable by all plot owners, covering 24-hour security, maintenance of common areas and roads, the communal spa and fitness centre, maid service, household rubbish removal and office management. It is payable in advance from the handover date to the end of that calendar year, then annually in advance on 1 January.

A one-time payment of 30,000 Baht per property (not per plot), due on completion and transfer, held in a separate account for future capital improvements to roads, common areas and shared infrastructure — items outside the annual common fee. Until the development is complete, all upkeep of roads and common areas is covered by the developer. Once residents are in place, a residents' association is planned to help decide how the fund is spent.

A fitness centre, spa pool, landscaped common gardens, roads, and 24-hour security with CCTV in all common areas.

Provided by external contractors arranged through the development management team. Approximate costs: swimming pool 2,000–2,500 Baht/month (serviced twice weekly incl. chemicals; water top-up for the owner's account); garden 1,500–3,000 Baht/month depending on plot size. Using the contracted companies is recommended during the first 12-month guarantee period; after that the choice of contractor is entirely yours. Payments are made directly from the homeowner to the contractor, coordinated by the management team.

Yes — the common fee is charged per plot because the overheads are calculated per plot. The sinking fund, however, is charged per property, so a single villa across two plots pays one sinking fund. Building a single villa across two adjoining plots is entirely possible; a layout drawing is prepared for your approval once plots are selected, with the extra space used for larger gardens or a guest house.

Guarantees

Two levels from the date of handover — a 12-month guarantee covering all items not in the structural guarantee, and a 5-year structural guarantee covering the house structure (piling, foundations, posts and ring beams, roof structure) and the swimming pool structure (the cast against leaking or cracking; all pools are piled against ground movement). Tiling, grouting and pool equipment carry the standard 12-month supplier guarantee. Thailand's legal standard guarantee is 12 months — the 5-year structural guarantee significantly exceeds this.

Snag rectification is carried out twice — at the end of the first month and again at the end of the 12-month guarantee period, with earlier rectification on request. A letter of satisfaction is signed on completion of all snag work at the end of the 12-month period.

After handover

Yes. A Rules & Regulations Agreement is signed alongside your construction and land lease contracts (a copy is available on request). It protects all homeowners and maintains quality of life on the development.

A dedicated on-site management team handles day-to-day matters including maintenance coordination, security, common-area upkeep and resident support. Full after-sales and management details are provided at handover.

As with any market, property values and rental income in Thailand can go down as well as up. Any estimates of capital appreciation or rental income are given in good faith based on available market data and are not guaranteed. We recommend treating property as a medium-to-long-term investment and doing your own independent research. Exchange-rate movements may also affect your final cost when transferring funds from overseas.
